Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, seller portal, and related services (collectively, the “Services”) operated by Attainer, Inc. doing business as San Francisco Data (“San Francisco Data,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of a company, you represent that you have authority to bind that company, and “you” refers to that company.
The Services
San Francisco Data helps companies package, price, and license proprietary data to qualified buyers, and helps buyers source and evaluate that data. The Services include our public website, the seller portal for sharing datasets and tracking ingestion, and related tools and communications.
Data licensing engagements — including dataset evaluation, clean-room access, license scope, pricing, and delivery — are governed by separate written agreements between the parties to those engagements. If a separate agreement conflicts with these Terms, the separate agreement controls for that engagement.
Accounts and access
Some Services require an account. You are responsible for the accuracy of the information you provide, for safeguarding your credentials, and for activity under your account. Access to the seller portal and internal console is limited to authorized users; we may suspend or revoke access that we reasonably believe is unauthorized or threatens the security of the Services.
Your content and data
You retain all rights in the data, files, and other materials you upload or connect to the Services. You grant us only the rights needed to operate the Services — for example, to store, process, secure, and display your materials to the people you have authorized — and, where an engagement agreement applies, the rights set out in that agreement. You are responsible for having the rights necessary to share what you upload or connect.
Acceptable use
- Do not attempt to gain unauthorized access to the Services, other users’ data, or our infrastructure.
- Do not probe, scan, or test the vulnerability of the Services without our prior written consent.
- Do not use the Services to violate law, infringe intellectual property or privacy rights, or transmit malicious code.
- Do not scrape, harvest, or bulk-extract content from the Services except as permitted by a written agreement with us.
Intellectual property
The Services, including their design, text, graphics, logos, and software, are owned by Attainer, Inc. or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works of the Services. “San Francisco Data” and the bridge mark are trademarks of Attainer, Inc.
Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Content on the website is for general information and is not legal, financial, or investment advice.
Limitation of liability
To the fullest extent permitted by law, Attainer, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services. Our aggregate liability arising out of these Terms or the Services will not exceed one hundred U.S. dollars (US$100) or the amount you paid us for the Services in the twelve months before the claim, whichever is greater. Liability under a separate engagement agreement is governed by that agreement.
Termination
We may suspend or terminate your access to the Services at any time for breach of these Terms or to protect the Services or their users. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — survive.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Services will be resolved in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction.
Changes and contact
We may update these Terms from time to time; the “Last updated” date above reflects the latest revision, and continued use of the Services after changes take effect constitutes acceptance. Questions about these Terms or our Privacy Policy can be sent to contact@sfdata.com.
